Who’s In The Envelope - Official Contest Rules

Until further notice, Entercom Milwaukee, LLC d/b/a 99.1 WMYX (“Station”) will conduct a “Who’s In The Envelope” Contest. Each contest (until a winner properly guesses the “person in the envelope”) will be a separate contest but will each such be governed by these contest rules (each, the “Contest”). Notwithstanding the foregoing, Station reserves the right not to conduct (skip) this contest on any particular day(s) between Contests, from time to time, in its sole discretion.
Who Can Enter
1. To enter, contestants must be legal residents of the State of Wisconsin, who are 18 years of age or older as of the date of entry.
2. Employees (including, without limitation, part-time or temporary employees) of the Station, contest sponsors and any other Milwaukee area radio stations, and their respective parent entities, subsidiaries, affiliated companies and advertising and promotion agencies at any time during the applicable contesting period and the immediate family and other household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners and siblings) of each of the above are NOT eligible to enter and/or to win the Contest.
3. Station may require proof of age, legal residency, identification and/or social security number prior to delivering a prize.
4. This Contest is open to anyone who meets the eligibility requirements set forth in these rules, regardless of having recently won a prize from Station in a different contest. However, contestants in any of these Contests may only win once every 30 days (only the first chronological prize won will be awarded).
How to Enter/How to Win
5. No purchase is necessary to enter or win.
6. Each weekday during a Contest (excluding holidays and days that Jane & Kidd are on vacation), listen to Jane & Kidd between 8:30-9am. During that period of time, they will solicit listeners to call the Station at 414-799-1099. Only those calls to that specific phone number shall be eligible to enter. Calls to the main radio station phone number or any other phone number are not acceptable. The 9th caller will have the opportunity to participate in that day’s contesting. If the Station receive less than 9 calls immediately following the Contest solicitation on-air, the Station reserves the right (in its sole discretion) to either not conduct the Contest that day (and continue instead on the following Contest day with or without adding the 99 cents) or re-conduct the Contest that day later in the morning. Station reserves the right, from time to time, to conduct this Contest before 8:30am or after 9am and will announce on-air any decision to change the time of the Contest either permanently or on a one-time basis (as determined by the Station and announced on-air).
7. Prior to the start of each Contest, the name of a “famous” individual will be written on a piece of paper by the Station management and put into an envelope and sealed. Immediately prior to the start of each Contest, Jane & Kidd will open the envelope to determine the name contained in the envelope. STATION WILL NOT ANNOUNCE THE NAME IN THE ENVELOPE NOR PROVIDE ANY HINTS WHATSOEVER ABOUT WHO THE PERSON NAMED IN THE ENVELOPE IS. The 9th caller will be asked to identity the name of the person in the envelope. The person may be a male or female. It is possible that the person may not have a first and last name (ie. Cher, King Tut, etc…). However, if they DO have a first and last name, the contestant must identify the person by both the first and last name (ie. Marilyn Monroe). The “person” will be a human being who currently lives or is dead. The “famous” person will be someone who has attained fame or infamy through any type of public attention, past or present (politics, crimes, movies, pop culture, history, etc…).
8. The 9th caller will be asked to guess the name of the “person” in the envelope. The caller may throw out several names but they will be asked to commit only to one final answer and any other names mentioned will be disregarded by the Station. The Station reserves the right to impose a time limit on a case by case basis to the amount of time a contestant has to answer (the amount of time need not be the same for each contestant). For example only, the Station may say “you have only 5 more seconds to give us your final answer.” If the Station accepts the answer as correct, that contestant will win the Contest and, subject to verification of eligibility, will win the Prize described below AND THAT PARTICULAR CONTEST WILL IMMEDIATELY END. If the Station does not accept the answer as correct, the Contest will be continued on the next Contest day and the incorrect guess will be posted later that day at the Station’s website www.991wmyx.com by clicking on the Jane & Kidd page.
9. Jane and/or Kidd, in their sole discretion, on a case by case basis, will be the sole judges as to whether or not the name is properly guessed or if the guessed name is “close enough” to win. This decision is not appealable nor negotiable and any decision in one Contest that a guess is “close enough” or “not close enough” may NOT be used by a contestant to argue that such decision is a waiver of any kind with respect to any subsequent answer in that Contest or a different Contest.
10. Contestants are encouraged to keep track of the incorrect name guesses previously selected by other contestants. If a contestant selects a name selected by a previous contestant, that contestant will not win any prize in this Contest nor will they be given another chance to guess.
11. Station is not responsible for loss of service to its contest lines or failure to make the call in time due to overload, busy signals, disconnected, misdirected, busy circuits, mechanical failures, or incomplete calls, or any other factor that may prevent an individual from completing his/her call to be the correct number caller. In the event of interruption of power or telephone service to both of the contest lines during the contest, the radio announcer will have the sole right to determine whether or not to replay the contest at the resumption of service or cancel that “play”.
12. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE RULES, ONCE A WINNER HAS BEEN ANNOUNCED THAT CONTEST WILL IMMEDIATELY END AND A NEW CONTEST WILL BE START WHEN ANNOUNCED ON-AIR.
13. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE RULES, IF ANY ONE CONTEST HEREUNDER CONTINUES FOR A PERIOD OF MORE THAN ___ WEEKS FROM THE DAY THAT PARTICULAR CONTEST STARTS, THE STATION RESERVES THE RIGHT AT ANY TIME THEREAFTER TO IMMEDIATELY TERMINATE THE CONTEST AND NOT AWARD ANY PRIZE IN THAT CONTEST.
Prize(s)
14. To start the contest, if the first contestant in the Contest correctly identifies the person in the envelope they will win $99.10. If they are incorrect, the Contest is over for the day and will resume the following Contest weekday, with the “prize pot” growing by ninety-nine cents ($.99). The Contest continues every Contest weekday (excluding holidays and Jane & Kidd vacation days) with the addition of ninety-nine cents ($.99) to the prize pot every day that there is an incorrect guess.
15. Once a contestant correctly identifies the “person” named in the envelope (subject to verification of eligibility) that person will win the total amount then in the “prize pot” and that Contest will end. Subsequent Contests will start over with a $99.10 prize pot and a new name in the envelope.
16. The minimum prize for this Contest is $99.10 to be paid to the winner by Station check. The maximum amount of money that can be won by any one Contestant depends upon the length of the Contest.
17. All checks must be picked up at the Station’s studios at 11800 W. Grange Avenue, Hales Corners, WI 53130 during normal business hours of 8am. to 5pm CST, Monday, Tuesday, Thursday, and Friday and 8am-7pm on Wednesdays. Checks will not be mailed. Promotions will notify the winner by phone when their check is ready for pick up. Checks will be made available no more than 6 weeks after winning.
18. Prizes will be released to winners only. Winners are required to present a valid state photo ID, social security number and any other information required by the Station in order to pick up any prize. All winners are required to sign a Release relieving the Station, its parents, subsidiaries, officers, directors, members, managers, employees, agents and contest sponsors from any and all liability with respect to the contestant’s participation in the contest and the receipt and/or use of the prize. Any person who refuses to sign the Release and/or provide a social security number will forfeit the contest prize.
19. No transfer or assignment of prizes is allowed.
20. Prizes not claimed within 60 days of being notified that it is available for pick-up shall be considered forfeited and will become property of Station. Such prize may be disposed of at the discretion of Station Management.
21. Winners are responsible for paying all applicable local, county, state and federal taxes on prizes based on the estimated retail value of the prize, as set forth in the contest rules, and will be issued an IRS 1099 form for all prizes won from Station where the aggregate value of all prizes is $600 or more.
Miscellaneous
22. Odds of participating in this contest depend on number of calls received.
23. Station Management shall be the sole arbiters in all matters relating to the Contest and in the interpretation of Contest rules. Their decisions shall be final.
24. Contest is subject to all applicable laws and regulations and is void where prohibited.
25. Station reserves the right to: (i) terminate or declare any Contest null and void and rescind any prize, if in its sole judgment, the rules or the integrity of the Contest have been violated or compromised in any way, intentionally or unintentionally by any person whether or not a participant in the Contest; (ii) alter or amend these Contest rules at any time; and (iii) stop or conclude the Contest at any time without prior notice. Material changes to the contest rules will be broadcast on-air, when practical.
26. By participating in the contest, participants consent to Station and their affiliates, employees, agents and all other related sponsors using for advertising and/or other promotional purposes, without additional compensation, all contestants' and winners', image, voice and/or biographical information on radio or TV broadcasts, newspaper advertisements and/or any other medium in connection with the contestants' participation with the contest.
27. By entering this contest, entrants agree that Station and other participating sponsors and their associated companies and sponsors accept no responsibility of liability in connection with any injuries, losses or damages of any kind caused by or resulting from (a) participation in the contest and/or (b) the acceptance, possession and/or use of any prize awarded hereunder.
28. Entry into the Contest constitutes agreement by contestants to abide by these rules.
29. Complete contest rules are available at the Station studios at 11800 W. Grange Avenue, Hales Corners, WI 53130 during normal business hours of 8am. to 5pm CST. Monday, Tuesday, Thursday, and Friday and 8am-7pm on Wednesdays or online at www.991wmyx.com.
30. Winner’s List: For a list of winners mail a self-addressed stamped envelope to the Station address identifying the name of the particular contest that you would like to receive a winner’s list for. The Station address is 1100 Olive Way Suite 1650, Seattle WA, 98199. All requests for winner lists must be mailed and received by the Station after the contest is over but prior to 4 months after the contest has been concluded.
